Access to Information

Anyone can have access to documents held by a public body, by submitting a request to that effect. Access to documents is governed by the Act respecting access to documents held by public bodies and the protection of personal information; this access concerns documents produced by the body as part of its functions. It should be noted that the Act excludes several documents such as sketches, drafts, certain analyses, etc.

Requests for access must be submitted to the person responsible for access to information within the body in question. They may be submitted verbally or in writing, but only a written request can be submitted to inform the Commission d’accès à l’information du Québec about a request for a review of a decision rendered by the person responsible for access to information within the body, as the case may be.

Requests for access to information must be sufficiently precise that the document requested can be located. As needed, the person responsible for access to information can provide assistance with formulating the request.

New Municipal Access to Information and Privacy Committee

The Municipality is responsible for the protection of the personal information in its posession. It is also responsible for the information when it is held by a third party. Under the  new Bill 64 ( Loi modernisant des dispositions législatives en matière de protection des renseignements personnels ), which amended the  Loi sur l'accès aux documents des organismes publics et sur la protection des renseignements personnels , the Municipality must create a new permanent Committee to carry out its obligations. Council, therefore, resolved to create a permanent Committee on Access to Information and Privacy ( Resolution  22-249, Council meeting of September 6, 2022 ). The Committee's mandate, among others, will be to define and recommend guidelines as well as governance rules related to the protection of personal information and privacy ( Resolution 22-250 Council meeting of September 6, 2022 ).
